Charge papers and usage of pre-trial restrictions in criminal proceedings

On September 16, 2021, the training course “Charge papers and usage of pre-trial restrictions in criminal proceedings” ended offline.

The course lasted from 14 to 16 September, during which the following trainings were provided: “Ensuring the legality of detention of a person”, “Charge papers”, “Application of precautionary measures”.

The event took place at the Prosecutors’ Training Center of Ukraine in partnership with a platform for the development and exchange of experience between criminal justice practitioners at the JustLearn site and the International Renaissance Foundation.

The course is based on a discussion on the possibilities of implementation of Standards of pre-trial investigation in the work of prosecutors, common understanding of basic standards of legality of detention, reasonableness of suspicion, expediency and proportionality of precautionary measures and service of a notice of suspicion and exercise of procedural powers during the application of precautionary measures in criminal proceedings.

How can prosecutors assess the legality of detention? What levels of reasonableness of suspicion are sufficient at these stages? Precautions: Is this the rule or the exception? The answers to these and other questions were received by the participants of the training course.
